Pin down the court level before you start. Felony charges, divorce, and civil suits over $25,000 sit with Circuit Court. Tickets, misdemeanors, small claims, and landlord-tenant disputes sit with District Court. Estates, wills, and guardianships sit with Probate Court. A case number speeds up any search. A full name works too, though the spelling must match the court file.

1. Identify the court level. Match the case type to Circuit, District, or Probate before you search.
2. Open MiCOURT Case Search from the county's own Circuit, District, or Probate page rather than a paid look-alike site.
3. Select the relevant Shiawassee court if the portal asks for a court or location.
4. Search by case number when you have it. This skips spelling problems and points to one exact file.
5. For a name search, enter the last name and add the first name to narrow the list.
6. Open the result and review the case number, parties, case type, status, register of actions, and hearing schedule.

Public Access Laws for Shiawassee County Court Records

Court files are open by default in Michigan, but not through the state's open-records act. Trial court records are kept under MCR 8.119, which makes case records public unless a law, court rule, or court order limits them. That rule, not a records request, controls what the clerk can hand over. The judicial branch is left out of the general Michigan FOIA route, so a FOIA letter to the court is the wrong first step.

Some material is nonpublic even in an open file. Under the MCR 1.109 personal identifying information rules, filers must shield details like birth dates, account numbers, and minors' data. Those items became nonpublic in 2022. Anyone may view a public file, and no reason or ID is required to look at the register of actions. Fees apply for copies and certified documents, set by the court that holds the case.

Sealed and Confidential Court Records

Not every case is open to the public. Juvenile records are the clearest example. Under MCL 712A.28, records of cases brought before the juvenile court open only by court order. Adoption files, mental-health proceedings, and many protected-party details are limited the same way. A public MiCOURT search will not surface these, and the counter staff cannot release them without the right order.

Convictions that have been set aside also drop out of public view. Under MCL 780.621 and the state's Clean Slate program, eligible convictions are removed from public criminal history, though some court and law-enforcement uses remain. A resident seeking a set-aside should confirm eligibility, list every Michigan conviction, and file the correct SCAO forms with the court that handled the case. Unpaid restitution can bring a set-aside conviction back after a court motion.

Requesting Shiawassee County Court Records in Person

When a file is not online, the counter is the next stop. The County Clerk is also the Circuit Court Clerk and keeps every 35th Circuit Court file. The public may review those files at the Circuit Court counter on the second floor of the historic courthouse in Corunna. Circuit Court is not an e-filing court, so filings arrive by mail or in person; email filing ended July 1, 2025 except for emergency motions and PPO matters. Bring a case number when you can, and expect copy and certification fees.

District and Probate Court Record Requests

The 66th District Court and Probate Court each hold their own files at the Courts and Defender Building. District Court takes record requests by email. Civil requests go to D66civil@shiawassee.net and criminal requests go to D66ct@shiawassee.net. Each request should carry the requester's full name, phone, email, and mailing address, plus the case number, the party name, and whether the request is for a full file, a single document, a transcript, or the register of actions. As with the Circuit Court, these are not FOIA requests, since court files fall outside Michigan FOIA.

Probate Court does not accept email filings. Filings and requests reach it by U.S. mail to 110 East Mack Street in Corunna, or in person Monday through Friday. Staff at any of these courts cannot give legal advice, and forms come from the state SCAO forms site.

Federal Court Records for Shiawassee County

Federal cases never show up in MiCOURT. Shiawassee County sits in the U.S. District Court for the Eastern District of Michigan, and its cases run through the federal system instead. The nearest federal courthouse for many residents is the Flint location, though the district also sits in Detroit, Ann Arbor, Bay City, and Port Huron. Federal civil suits, federal crimes, and civil-rights cases are handled there, not at the county courthouse.
